1. Who We Are

Forward Creative LLC (“Forward,” “we,” or “our”) is a Georgia-based creative media agency offering video production, podcasting, photography, design, and marketing services. We serve churches, nonprofits, and businesses through one-time projects and monthly retainers.

2. Working with Forward

Retainer Clients

For ongoing monthly retainers, payment is required in full before the 1st of each month. Services begin only after that payment is received. There is no deposit structure for retainers; however, a one-time setup fee may be required depending on the service tier or onboarding needs. Your payment secures your spot on our calendar and unlocks access to our creative team for the month ahead.

One-Time Projects

For all non-retainer services (including standalone videos, branding, photography, etc.), we require a non-refundable deposit of 40% to initiate work. The remaining 60% is due upon final delivery of all project materials. Work will not begin until both the signed agreement and deposit are received.

3. Ownership & Usage Rights

All creative content produced by Forward — including final deliverables, raw files, and editable project assets — remains our intellectual property until the full project balance is paid.

• You are granted usage rights for the agreed-upon purpose and platforms.
• You may not resell, claim authorship, or transfer rights to others.
• Providing raw footage, project files, or source assets does not transfer copyright unless explicitly stated in writing.
• Logo and branding assets provided are for your use, but Forward retains creative authorship and may display them in our portfolio.

Forward reserves the right to showcase completed work in our portfolio, reels, and promotional materials unless otherwise agreed upon in writing.

4. Revisions & Delivery

Each project includes a defined number of revisions as stated in your proposal or contract. Additional edits outside of the agreed scope may be billed separately. Standard delivery is within 14 business days of the shoot or final draft approval, unless otherwise stated.

5. Refunds, Cancellations, & Rescheduling

• Deposits are non-refundable.
• Retainer payments are non-refundable once the month has begun.
• If you cancel a shoot or scheduled work, we require at least 48 hours' notice. Missed or late cancellations may result in rescheduling fees.
• In the event of unforeseen circumstances on our end, we will communicate quickly and reschedule in good faith.

6. Client Responsibilities

• Provide necessary assets (logos, content, etc.) in a timely manner.
• Communicate clearly and professionally.
• Respect deadlines, boundaries, and creative direction once approved.

Failure to provide timely communication or content may delay delivery or result in project termination at our discretion.

7. Acceptable Use of Our Website

• You may not use this site for unlawful or harmful purposes.
• You may not copy, scrape, or reproduce any content without permission.
• You may not misrepresent your identity, project, or intentions when contacting us.

8. Limitation of Liability

Forward Creative is not liable for:

• Indirect, incidental, or consequential damages — including loss of revenue, business opportunity, or reputation.
• Technical failures or interruptions related to third-party platforms (social media, hosting, etc.).
• Misuse, alteration, or unauthorized redistribution of deliverables beyond the usage rights granted.

Forward provides finalized media with defined usage rights, not performance guarantees. Once assets are delivered, responsibility for how they are used, displayed, or interpreted lies with the client. In any case, our maximum liability shall not exceed the total amount paid to Forward Creative for the project in question.

9. Privacy Summary

We value your privacy. Any contact form submissions, inquiry details, or project assets are used solely to serve your project or communicate with you. We do not sell or share your information. Credit card details are never stored on our site. Read our full Privacy Policy.

10. Governing Law

These terms are governed by the laws of the state of Georgia, regardless of the client’s location. Any disputes will be handled in the appropriate courts located in Georgia, United States.

11. Updates to These Terms

Forward Creative reserves the right to update these terms at any time. The current version will always be posted here. Continued use of our site or services constitutes agreement to the current terms.
